Article 1 - Definitions

  1. Paw Luxe Boutique, located in Almere, Chamber of Commerce number 95793399, is referred to in these general terms and conditions as the seller.
  2. The counterparty of the seller is referred to in these general terms and conditions as the buyer.
  3. Parties are the seller and the buyer together.
  4. The agreement refers to the purchase agreement between the parties.

Article 2 - Applicability of general terms and conditions

  1. These terms and conditions apply to all quotations, offers, agreements and deliveries of services or goods by or on behalf of Paw Luxe Boutique.
  2. Deviations from these terms and conditions are only possible if expressly and in writing agreed upon by both parties.

Article 3 - Payment

  1. The full purchase price is always paid immediately upon ordering in the webshop. In some cases, a down payment may be required for reservations. In that case, the buyer will receive confirmation of the reservation and the advance payment.
  2. If the buyer does not pay on time, they are in default. The seller can then suspend their obligations until payment has been made.
  3. If payment is not made, collection will follow. The costs thereof are for the account of the buyer and are calculated based on the Decree on compensation for extrajudicial collection costs.
  4. In the event of bankruptcy, attachment or suspension of payment of the buyer, all claims of the seller are immediately due and payable.
  5. If the buyer refuses or delays the performance of the agreement, they remain liable for the agreed price.

Article 4 - Offers, quotations and prices

  1. All offers are non-binding, unless a specific validity period is stated.
  2. Delivery times in quotations are indicative and do not entitle the buyer to dissolution or compensation in case of exceeding.
  3. Offers and quotations do not automatically apply to reorders, unless agreed in writing.
  4. All stated prices include VAT and any other government levies, unless stated otherwise.

Article 5 - Right of withdrawal

  1. The buyer has the right to dissolve the agreement without stating reasons within 14 days of receipt.
  2. Custom-made products or hygiene products whose seal has been broken cannot be returned.
  3. Returns must be sent back in original, undamaged condition and packaging.
  4. The costs of return shipments are for the account of the buyer, unless there is an error or defect in the product.

Article 6 - Amendment of the agreement

  1. If it is necessary for a proper execution of the agreement to make changes, the parties will adjust them in mutual consultation.
  2. The seller will inform the buyer as soon as possible if changes have consequences for the price or delivery time.

Article 7 - Delivery and transfer of risk

  1. As soon as the buyer receives the product, the risk transfers from the seller to the buyer.

Article 8 - Inspection and complaints

  1. The buyer must check the delivered product immediately after receipt.
  2. Complaints about damage, shortages or other defects must be reported in writing within 10 working days after delivery.
  3. In the event of a valid complaint, the seller has the right to repair the product, replace it, or issue a refund.
  4. Complaints about one product do not affect other products within the same order.

Article 9 - Delivery

  1. Delivery takes place according to the chosen shipping option.
  2. If the buyer is not present to receive or provides incorrect information, any additional costs are for their account.
  3. Delivery times are indicative and not strict deadlines. In case of exceeding, the buyer must give the seller notice of default.

Article 10 - Force Majeure

  1. The seller is not liable if they cannot fulfill their obligations due to force majeure.
  2. Force majeure includes: natural disasters, strikes, pandemics, government measures, transport problems and other situations beyond the control of the seller.
  3. If force majeure lasts longer than 30 days, both parties have the right to dissolve the agreement.

Article 11 - Retention of title

  1. Products remain the property of Paw Luxe Boutique until full payment has been received.
  2. The buyer may not resell, pledge or encumber the products before full payment has been made.

Article 12 - Liability

  1. The seller is only liable for direct damage resulting from gross negligence or intent.
  2. Liability is limited to the invoice amount of the relevant order.
  3. The seller is not liable for consequential damage, indirect damage or damage due to incorrect use of the products.

Article 13 - Complaints procedure

  1. Complaints must be submitted in writing within a reasonable period via pawluxeboutiquenl@gmail.com.
  2. The seller will respond substantively within 14 days. If this is not possible, the buyer will receive an indication of the expected response time.

Article 14 - Warranties

  1. Products must meet the reasonable expectations that the buyer may have of them.
  2. The warranty expires in the event of damage due to improper use or modifications to the product by the buyer.
  3. If a third party provides the warranty (e.g., a manufacturer), only their warranty policy applies.

Article 15 - Intellectual property

  1. All intellectual property rights relating to the website, products and marketing materials remain the property of Paw Luxe Boutique.
  2. Copying, distributing or commercially using content without permission is not permitted.

Article 16 - Changes to the general terms and conditions

  1. Paw Luxe Boutique reserves the right to amend or supplement these general terms and conditions.
  2. Changes of minor importance can be implemented at any time.
  3. Consumers have the right to cancel the agreement in the event of a significant change.

Article 17 - Applicable law and competent court

  1. All agreements are exclusively governed by Dutch law.
  2. Disputes will be submitted to the competent court in the district where Paw Luxe Boutique is located, unless otherwise stipulated by law.
  3. The application of the Vienna Sales Convention is excluded.
