Article 1 - Definitions
- Paw Luxe Boutique , established in Almere, Chamber of Commerce number 95793399 , is referred to in these general terms and conditions as the seller .
- The counterparty to the seller is referred to in these general terms and conditions as the buyer .
- The parties are seller and buyer together.
- The Agreement means: the purchase agreement between the parties.
Article 2 - Applicability of general terms and conditions
- These terms and conditions apply to all quotations, offers, agreements and deliveries of services or goods by or on behalf of Paw Luxe Boutique .
- Deviation from these conditions is only possible if this has been expressly agreed in writing by both parties.
Article 3 - Payment
- The full purchase price is always paid immediately upon ordering in the webshop. In some cases, a deposit may be required for reservations. In that case, the buyer will receive confirmation of the reservation and the prepayment.
- If the buyer fails to pay on time, they are in default. The seller may then suspend their obligations until payment is made.
- If payment is not received, collection will follow. The costs of this collection will be borne by the buyer and will be calculated based on the Decree on Compensation for Out-of-Court Collection Costs.
- In the event of bankruptcy, seizure or suspension of payments of the buyer, all claims of the seller become immediately due and payable.
- If the buyer refuses or delays the performance of the agreement, he remains liable for the agreed price.
Article 4 - Offers, quotations and prices
- All offers are without obligation, unless a specific validity period is stated.
- Delivery times in quotations are indicative and do not entitle the buyer to cancellation or compensation if exceeded.
- Offers and quotations do not automatically apply to repeat orders, unless agreed in writing.
- All prices listed are inclusive of VAT and any other government levies, unless otherwise stated.
Article 5 - Right of withdrawal
- The buyer has the right to cancel the agreement within 14 days after receipt without giving any reason.
- Custom-made products or hygiene products whose seal has been broken cannot be returned.
- Returns must be returned in their original, undamaged condition and packaging.
- Return shipping costs are the buyer's responsibility, unless the product is faulty or defective.
Article 6 - Amendment of the agreement
- If changes are necessary for the proper performance of the agreement, the parties will adjust them in mutual consultation.
- Seller shall inform buyer as soon as possible if changes affect price or delivery time.
Article 7 - Delivery and transfer of risk
- Once the buyer receives the product, the risk passes from seller to buyer.
Article 8 - Investigation and complaints
- Buyer must check the delivered product immediately upon receipt.
- Complaints about damage, shortages or other defects must be reported in writing within 10 working days of delivery.
- In case of a justified complaint, the seller has the right to repair, replace or refund the product.
- Complaints about one product do not affect other products within the same order.
Article 9 - Delivery
- Delivery will take place according to the chosen shipping option.
- If the buyer is not present for receipt or provides incorrect information, any additional costs will be borne by the buyer.
- Delivery times are indicative and not final deadlines. If delivery times are exceeded, the buyer must notify the seller of the default.
Article 10 - Force Majeure
- The seller shall not be liable if he is unable to fulfil his obligations due to force majeure.
- Force majeure means: natural disasters, strikes, pandemics, government measures, transport problems and other situations beyond the seller's control.
- If force majeure lasts longer than 30 days , both parties have the right to terminate the agreement.
Article 11 - Retention of title
- Products remain the property of Paw Luxe Boutique until full payment has been made.
- Buyer may not resell, pledge or encumber the products until full payment has been made.
Article 12 - Liability
- Seller is only liable for direct damage resulting from gross negligence or intent.
- Liability is limited to the invoice amount of the order in question.
- Seller is not liable for consequential damage, indirect damage or damage due to incorrect use of the products.
Article 13 - Complaints procedure
- Complaints must be submitted in writing within a reasonable time via pawluxeboutiquenl@gmail.com .
- The seller will respond substantively within 14 days . If this is not possible, the buyer will receive an indication of the expected response time.
Article 14 - Guarantees
- Products must meet the reasonable expectations that the buyer may have of them.
- The warranty is void in case of damage caused by improper use or modifications to the product by the buyer.
- If a third party provides the warranty (for example, a manufacturer), only their warranty policy applies.
Article 15 - Intellectual property
- All intellectual property rights relating to the website, products and marketing materials remain the property of Paw Luxe Boutique .
- Copying, distributing or commercially using content without permission is not permitted.
Article 16 - Changes to the general terms and conditions
- Paw Luxe Boutique reserves the right to change or supplement these terms and conditions.
- Minor changes may be made at any time.
- Consumers have the right to cancel the agreement in the event of a material change.
Article 17 - Applicable law and competent court
- All agreements are exclusively governed by Dutch law .
- Disputes will be submitted to the competent court in the district where Paw Luxe Boutique is established, unless otherwise provided by law.
- The application of the Vienna Sales Convention is excluded.
